There are basically 3 types of bankruptcy in Ottawa. They are Voluntary Assignment, Involuntary Assignment & Deemed Bankruptcy. Let’s quickly define all three.

What is Voluntary Assignment In  Bankruptcy?

Voluntary assignment is where an insolvent person, without being forced by law, makes an assignment of all their assets for the general benefit of all their creditors. Any surplus money would be returned to the debtor. Voluntary assignment is the most commonly used form of bankruptcy in Ottawa.

What Rights Does an Bankrupt Have?

It is not illegal to be Bankrupt, but of course, there are rules to abide by but they are mostly common sense.

The Benefits of Personal Bankruptcy

You eliminate most of your debt however some debts may survive such as student loans, alimony/support, and a few others. You are able to resume your life without making most debt payments and you retain a larger part of your income. You get the monkey off your back and you can finally breathe easier. What is a Consumer Proposal?

A consumer proposal is a binding legal agreement with your unsecured creditors whereby you undertake to pay back your debt without interest. This debt can be compromised and your proposal can be paid in a lump sum, by payments not exceeding five years and or a combination of both.

How much does a consumer proposal cost in Ottawa?

Licensed Insolvency Trustees (LIT’s) are the only people that can help you file a consumer proposal. So the administrators (LIT) fees are regulated by law and the fees usually come out of the payments you make. There are no additional fees tacked on.

Three reasons why a Consumer Proposal is worth it?
  1. You will probably pay less money back than what you originally owed.
  2. The interest stops on most of your debts.
  3. Your proposal can be made over a maximum of five years.

Qualification for a Consumer Proposal

You must be an insolvent person as defined in the Bankruptcy and Insolvency Act. (BIA) Your unsecured debt must be less than $250,000 excluding the mortgage(s) on your principal residence. You must be able to meet the obligation you presented to your creditors in your consumer proposal.

What unsecured debts can I include in my credit proposal?

All of your unsecured debt can for part of your consumer proposal such as, loan, lines of credit, credit cards, income tax etc… However certain creditors have a special status under the law where by their debt may survive.

How long does a consumer proposal stay on your credit report?

Your credit will be affected while you are under your consumer proposal and will slightly get better once you have completed it.
